My bro. was calling this chick for a couple of months just to come over and get laid. When she found out she was pregnant two months, my bro denied he was the father and threatened her to get a DNA test once the baby was born. She agreed which my bro now believes it's his just because she is willing to DNA test, but once her family found out, her cousin's girlfriend text my bro saying it's not his and she's lying. It caused a lot of conflict between them two that now they don't even talk anymore.

My bro. tried once, showing up at the door to talk but she threatened him with a restraining order if he comes to her house again. The baby is not due till April 2014 and it's killing to see my bro. hurt, confused and not knowing what to do to help himself in this drama. I just want to protect him and his rights. I heard to many stories of women forging the fathers name on the birth certificate and getting screwed with child support and the hassle plus money wasted just to get their names off and cleared of payments.

So all I want to know is what can we do? As for right now I advised my bro. to stay away till the birth of the baby, but I'm worried we won't get that phone call from the baby mama.

There isn't much he can do until the baby is born. He needs to look at registering with the punitive father registry before birth. Then after the baby is born he goes to court to ask for a DNA test and visitation. The DNA test has to be one that the court orders. Once the results come back then he will either be given an order for visitation and an amount to pay in support every week (if he is the father) or he will go on about his live as though nothing happened (if not the father). I have to ask though... you said "pregnancies" so has this happened more than once?

Don't believe everything you hear.

The parents of a new-born do not sign the birth certificate. The mother (or her husband, if they are marred) would sign the report of live birth. If they are not married, the putative father would have the option of signing an affidavit of paternity. Such an affidavit has to be notarized; it is unlikely that the mother could forge this; if she did the notary would be in serious trouble.

First, it is putative father registry. Most states have them and he can register with it.

She could list a different person as the father, but as soon as he knows about the birth he can file for paternity.

It's putative, not punitive, and California doesn't have a putative father registry.

It is true it is putative. I missed a key in typing and it was corrected for me to the wrong word (my fault should have proofread). But if California doesn't have one then waiting until birth to ask for a DNA test is the next action.

So that's the gist of the laws. What puzzles me is that you are killing yourself over protectiveness of an irresponsible brother, who had all the fun of sex with no regard of the consequences, PLUS he told her it wasn't his, and now suddenly is hurt and confused that it might be and he'd be refused the right to be a father. Gee, is he 12 or something? As for all the concern about money for support, that's the way the cookie crumbles, if it's his kid.
