Hello. I live in Oklahoma and my daughters father is in prison again. This is his 4th time down and he is a registered violent offender. I am trying to get as far away from this man and his family as possible he is serving time due to probation revokation again. For marijuana and meth. He has been gone since June 4th 2013. Are these grounds enough for file abandonment on his part and proceedings with the divorce?

Please refer to the :" sticky "regarding abandonment. Also refer to Oklahoma statutes regarding this topic. DHS - Oklahoma Department of Human Services (http://www.okdhs.org)

You dont need a reason to file for divorce. Also you can use his violations and prison sentence to have his rights stripped if he presents a danger to the children. You can't file for abandonment as there is no legal argument for it. Being in prison he can't possibly be there to support the children. So that argument is null.

As noted, you don't 'file for abandonment". Every state has no fault divorce now. So you file for divorce. If there are children then you use his criminal record as grounds for severing his parental rights.
