View Full Version : How do I divorce someone I can't find?

Ok its kind of complicated. About 7 years ago I was getting out of a bad relationship and started dating a friend of mine. We cared about each other a lot but I found out I was pregnant from the relationship I had ended recently. He knew I didn't want to have the baby alone and proposed and was there through everything. About a month after my son was born he was deported and I never heard from him or saw him again. I tried to find him but all I heard was that he was married in Egypt (where he was from).

Now 6 years later I'm engaged and want to marry but have no idea how to get a divorce from a man I can't find and wondering if I can have it annulled for the simple fact we never consummated our marriage due to my being pregnant with another man's baby.

Oh and I also no longer live in the state we were married in and would be next to impossible for me to get there.

Get a lawyer. You have to prove to the court that you have made a good faith attempt to find and contact your ex. If you can the court should grant a divorce.

You need to file for divorce where you are so long as your a resident of the State. Then as you proceed through the process you can ask the judge for instructions explaining that you dont know where he can be found. You may be able to get a defauly divorce through publication. The judge has to allow it.
