View Full Version : Getting money back from my ex partner

Myself and my partner were together for just under 5 years before we broke up a month before our anniversary last year.

Over this time we had moved out of our parents and at the time were in our 2nd rented accommodation, when the split happened we sat down and discussed payments etc for outstanding items such as a Credit card, store card and eventually if he ended the contract at the property my half of the deposit back, nothing was written down but was spoken as at the time neither of us had any issues and the split was on friendly terms.

In March this year he changed his tune however after deciding he didn't like the person I am now with so since then has caused nothing but issues in getting my payments back, I've even had debt collectors calling me because of bills he left unpaid when he left the property we shared in August stating I was meant to be paying the bills! A whole year on!

The original arrangement was:

£400 to me for the deposit return whether this was the amount he got back or not
Half of the current total on the credit card
Half of the current total on an Argos store card

I found out after he left the property however that he was only due to get £360 back from our £800 deposit and suddenly turned round and first of all said he owed be F* all and then that I was only having £180 back if anything.

The 2 cards are both in my name only as he had really bad credit and they were used to pay for things like the dogs food and any vet visits (which I no longer have access to as he refuses to let me see her) the Argos store card was used to cover payment for a mattress which he said we needed and would pay off before the end of the 2 year 0% interest deal ran out, I no longer have this mattress as he kept it when I left so I am basically now paying for something I don't even own.

I haven't had any of the payments from him and I am stuck on what to do, the only document with my name on for any of those payments will be the Deposit but he did go and change all my contact details with the DPS without my knowledge so all it now shows is my name, I did have a go at them as I didn't authorise it but they said he was lead tenant so can basically do what he wants. The other payments are only my word against his now as the card was for things we owned together at the time.

I live on my own and really can't afford to try and pay all of this off on my own without anything from him as I have my own bills to pay.

Does anyone have any idea what I can do or if it would stand in court without any documents etc?

Your chances of obtaining and collecting a judgment against him are about the same as those of a proverbial snowball in Hell.

The court is going to need more proof of an agreement than you appear to have, for one thing, and he is probably judgment-proof, for another thing.

Next time you co-mingle your finances with someone, get married to that person first. It would have helped.
