Hi,

I am on H1-B and I am a bit confused about W-9 forms. I need to fill one out for my 401k company. Is this correct? If so, what box should I check? They have a referral program where you can receive money per signup if you refer a friend and they sign up. It seems that clients of the 401k company are automatically part of this program, but I do not intend on participating in this. I am just confused about this in relation to my H1-B status.

If you are under an H-1B visa, you will file as a resident alien, so Form W-9 is the correct form for you.

You CAN get money for referrals as long as you report the income on Line #21 of Form 1040.

Thanks for your help!

I am confused about what box to check on the w-9. Individual or Exempt Payee? I have asked my 401K company about this but haven't yet heard from them.

You are NOT an exempt payee, so go with Individual.
