I have a roommate that is not on my lease. I got permission from my LL. To have her here. She refuses to pay her portion now.. she says I can't evict her. I'm a struggling 53yr. Woman. I had to pay the whole rent by myself. I've asked her to leave j she says "when i find another place". In the meantime.. she uses my appliances.. electricity etc. Can I remove her food from MY refrigerator to make her as miserable as she is making me?

Who says you can't evict her? The person who doesn't want to pay her rent?

If she's not on the lease.. then she is subletting from you... and you can have her evicted...

What state is this?

Of course you can evict her. But you're going to have to give us more details before we can tell you how to go about it. What state are you in? Do you have a written agreement with her? If so, is it for a specific time or is it month-to-month?

As noted, she is lying when she she says you can't evict her. You certainly can. But to tell you how you need to tell us a) where you are (general locale so we can check the law), b) whether you have a written agreement with her, c) when was she supposed to pay rent (weekly, monthly), d) whether the agreement you had (written or oral) included use of the refrigerator.

Please respond ASAP so you can give her notice ASAP.

Oh, but yes, you will need to pay the whole rent until you can get her out. You will be able to sue her for what she hasn't paid.
