View Full Version : How do I remove an 8 and 11 year old eviction from my records?

I have two evictions on my record: one in 10/2002 and one in 10/2005. The latter resulted in a Civil Judgment. How can I remove these from my record. Also, shouldn't they "fall off" on their own after they are seven years old?

'Remove' them? You don't. Unless you know a bunch of people you can bribe.

Records don't fall off. You might be thinking of how far background checks go - people who pay for them can pay for different lengths of time.

First, you have to define what record. If you are referring to a credit report by one of the major credit bureaus (like Experian), then yes, it should "fall off" after 7 years. But if you are referring to a court record, no, they don't fall off. Especially not a civil judgment.

Actually, there is a federal act, the Fair Credit Reporting Act, (http://en.wikipedia.org/wiki/Fair_Credit_Reporting_Act) which prohibits credit reporting agencies from reporting debts which are that old or older. However, as noted, that doesn't prohibit anyone from reviewing the court file to find judgments against you which can be of any age.

Reporting debts yes. That's what I said. But an eviction is a civil action and may be reported in court records.

I suspect that what the OP is referring to is a rental record maintained by a landlord organization.
