I need my Uncle to Move. The apartment that I reside in use to be my grandmothers. She passed and the Section 8 Voucher switched over to my name. Ever since that happened I told him he can no longer live here. He refuses to move and I'm really unsure of the process that I would have to go through to get him out in Maryland. I want to just change the locks and put his stuff out but I'm hearing I can't do that. Can someone please help me.

What is his age? You can get him out and you will get plenty of advice on how to do it here. Just wondering what the particulars are and if you are comfortable and prepared for the ramifications of what will become of him once he is on the street.

Give him a written notice that he has to vacate in 30 days. If he doesn't vacate by the deadline, then you need to go to your local housing court for an eviction order.

He is a 48 year old with a job. There is nothing mentally wrong with him. He was staying with my grandmother because he just came home from jail. He can get an apartment, house or room somewhere he just refuses to leave.

Since Section 8 is covering you, the local housing office should be able to help you act faster than eviction, I would hope (but I don't know). After all it's taxpayer funds and they have a tradition of being strict about everything.

I never thought to call them. I'm always concerned that they would evict me because I'm violating there terms.

Is he on the section 8 voucher? He may.be there illegally since section 8 does a criminal check and doesn't approve some criminal acts. How did you manage to even transfer sect 8 to your name? I tried getting my name off mine and leave my adult sons name on and they said they can not do that.

He's is not on the voucher. The voucher was in my grandmothers name and I was on her lease. I notified her case worker in housing about her condition and she told me that it would just transfer over to the next person who was over 18. I had to fax her a funeral program and she did the rest.

He is there illegally then because sect 8 requires every one in the house to be registered with them.

Yes. I get that he may be emotionally attached because everything here is Hers but this Man told me that he would set the apartment on fire before I put him out.

You need to alert sect 8 that he was here prior to your obtaining the voucher, you want him out and he is making violent threats.

Call the police too, about the fire, and all of it. You may be able to get a restraining order, and that will get him out right away, with a police escort.

Do it asap Tuesday because you can lose your voucher with him staying there under the radar.

As was mentioned... at the first threat call 911 no matter what time or day it is.
