Don't know the biological father and there is no name listed on the birth certificate. My husband wants to put his name on the certificate but the court said I needed the biological fathers consent and release of the child. Is there a way to go about doing this without the biological father to be involved in any way?

No. The biological father has rights. You can't just take those rights away because someone else is willing to accept responsibility for this child.

Do you have a list of potential fathers for this child? If so, it's time to contact them for DNA testing. If not. Why?

Unless you were raped, and I'm very sorry if that was the case, you do have an idea of who the father could be. You will have to contact those men in order for a DNA test to be done and for their approval for the adoption to take place.

The step father can't just pout his name on the birth certificate. This is a process called adoption and it's a legal process that has to be followed.

As part of the process the court will require that you name all potential fathers and that you attempt to contact them to have a DNA test done so the actual father can consent to the adoption.

The local court will have a specific rule and policy in trying to locate the possible father.

You will have to provide possible list of men, and attempt search.
