Hi, I just moved out of an apartment and ,y landlord sent me a letter saying he is keeping the deposit plus charging me 800 dollars for replacement of carpet to restore it to new. Can they do this? I lived in the apartment for 2 years.

What was the condition of the carpet when you moved in? When you moved out? Do you have pictures?

The carpet must be in the same condition as when you moved in except for reasonable wear and tear. If the landlord is claiming that the carpet was new when you moved in and that it will cost him the amount of your deposit plus an additional $800 to restore it to like new condition then your only options are to either send him the $800 or file a lawsuit for the return of your deposit.

If you file a lawsuit, and if the landlord comes into court with any kind of proof that the carpet needed to be replaced, then you're going to lose. If the landlord doesn't have any proof and you don't have any proof then it will just be your word against his and it could go either way.
