Is it a hippa violation for a court to allow copies of an evaluation of family members to everyone involved in a custody case? Everyone involved received an evaluation from social workers. The court then ordered the eval given to my ex husband who constantly brings up the content in it to me. The court then ordered that the eval cannot be used in the custody hearing. Was it a violation of my mental health rights to have this eval given out to my ex husband?

No, this law applies to health care workers, courts and the legal system is free to use them as needed. It is evidence and is allowed to be reviewed and evidence has to be given to the other side. If latter if not allowed to be used. It was still proposed as evidence.

First its HIPAA, second it applies only to medical providers and your medical records. Third, this evaluation was part of the court record.
