I received a civil action hearing notice for a past due credit issue.

1.Can they make me come up with the whole amount at once and not accept monthly installments?

2. Can they take it out of my paycheck without me allowing it?

3. Can they make me sell items in my home to come up with the money?

I live in Pa. and want to pay this back but can't all at once. This is my first time with something like this and it will be the last! The hearing in April any help would be great. Thanks Pa-Jay

Hello Pa:

If they win and get a judgment, they'll garnish your paycheck and attach your bank accounts. No, they can't make you sell anything, but you might want to, because working without a paycheck sucks.

If they take you to court ( civil) and win, the judgement will be for the full amount plus court and legal fees. ( so you will owe more after court than before)

Yes of course that is what the court order is, a order to make you pay and they may garnish your pay, it will vary as to how much depending on where you live, they also can take all of the money out of your checking or savings account

Normally they can't make you sale

Thanks for all your help I called and set up payments with the credit company. A ton of bricks was lifted off my head.
