After mom died, I stayed away from siblings, because they went through her money, my sister had moms money in her bank account, my mom had no say so in her own money, she wasn't incompetent or nothing, my sister told her she couldn't have a bank account because she had no income, my deceasd brother left my mom, his insurance money[policies], so that's where the money came in, mom bought her home cash, my sister was there, she told moms to get that house, its in her neighborhod, my mom didn't even have a bank account of her own, or a bank card to my sisters, basically, she stole moms money, now I think shee is lying about a will. she still insists she has a will, I was named executor by the courts, because I am trying to get to the bottom of this, is is possible that she really do have a will. She swears on it, but won't produce it.

My brother and daughter live in the house, they had an altercation, my brother now says its his house, my niece says its her house, I am confused, the house deed, has no one name on it, but moms, the courts said there was no will, so she[sister] keep saying she has proof, I know she went with mom to purchase house, she said the lawyer witnessed it, if she did this, and it wasn't recorded, is her will legal?

Has the estate been through probate? If so that is the time to address wills and such. They can present evidence of one by producing it or they cant. If they can't then the rules of your state will be followed and distribution can take place of the estate.

If you tell us where she lived, we can tell you the rules if someone dies intestate (without a will). If no one can find a will this could drag on for years. Ask around local lawyers, starting with the one who was present for the buying of the house. Wills aren't 'recorded' when someone is alive. They are notarized with witnesses and usually at least 2 people have a copy, and the lawyer keeps the original.
