I live in ca and have a renter in my home(I am owner of prop) without written agreement. Verbally told him we would try for a month or two to see if we are compatible. I soon realized he was a serious drunk who never sleeps. I asked him to leave after 7 weeks. It is now over 2 months since then and he won't leave. I have 2 teenage daughters and this man continually tries to sneak girlfriend in for loud disgusting sex. Walks around in boxers even thou my husband has asked him not to. He is a raging drunk in his 50's who doesn't think rules apply to him. I told him that as we are non drinkers his drinking is too much to deal with. I don't trust him to b alone in my home. My girls are afraid of him and due to his obnoxious drunkiness my 13 yr old can not have friends over to the house when he is home. I want him out!

It is considered his legal address you have to get a court order

First, Why have you done nothing for 2 months? Second, before you allow someone to live in your home, you should learn the rules about it.

From your description he may qualify as a lodger. If he does, you give him 30 days written notice and I would also inform your local police that you are doing so.
