View Full Version : Police search my home under probation search when no one is on probation in the home

My house was searched under a probation search and no one in the home was or has ever been on probation. I asked for paper work or a search warrant and the police refused to provide anything and said they did not have to. My 17 years old daughter was the only one home at the time and they told her they were coming in no matter what. I arrived home minutes later and asked for them to leave or show me a warrant and they refused. After searching the home they said they could come in anytime they wanted because my son was on a felony probation and there is nothing I could do. Well it turns out my son had nothing on his record and they had made a mistake. It was the wrong person and the wrong house. What can I do about this? I am in Ca.

You can forget about it... unless of course you want them to make an example of you (meaning you and you family had better be squeaky clean and NEVER even get pulled over on a traffic violation... because their ability to make a judgement call on something will not fall in your favor... and trust me... make a huge stink and they will because they can.

Better to have a reputation as being friendly than adversarial.

And incidentally... if THEY were told your son was on probation... the mistake may have been higher up and unlikely originated by the troopers who showed up... and no they DON'T need a warrant on those.

Better to have a reputation as being friendly than adversarial.When the authorities have run ROUGHSHOD over your rights, laying down for them is the exact WRONG thing to do. At least in my circles, it is.

You seem to support the cops in EVERY one of your posts here on this board. Maybe you should start a cop appreciation page.. THIS page is for people who the cops F***ED over.

EX... I know enough cops to know that like most people... they will want to get back at you if you screw with them... only they hyave a lot more means available to do so at their disposal.

And I know the ways they will do it.

There is an old saying that applies here... "Choose your battles carefully".

I agree. The cops are lousy pieces of sh*t who retaliate against citizens who stand up for their rights.. However, for one who knows how to use the law, as I do, I can inflict a lot of damage too. In my view, cops, like any BULLY on the street, pick on the helpless and the hapless. They DON'T pick on people who have big bats in their hand.

I carry a BIG bat. It's called the Constitution, and the courthouse is my playground. I thought right wingers loved the Constitution. No, huh? I'll show ANYBODY how to use it so the cops can't f**k 'em over like you're SOOO happy they do...

The answer is simple - you hire an Attorney. You will get nothing done by yourself.
