I live in IN. I have a three yr old son. My sons father was in prison when he was born so he never signed the birth cert. Since I was on medicaid for prenatal and postnatal care, the gov. decided to make me establish paternity for my son. So my son's father and I are supposed to be going to court for DNA and child support, but I want another man to sign his because. I have a fiancé who will sign and accept all responsibilities of being his father. Is there anything I can do to stop the progression with my county's prosecutor to have my fiancé be named my sons legal father. If you need any other info let me know. Please help time is limited! Thank you!

No, there is a legal father, the bio father is the legal father and has rights and obligations, even if you don't want him tol

Before your fiancé can adopt, you will need the real bio father to sign his rights away to you for him to adopt.

You will need to est though DNA that this is the real father, so he can sign his rights away.

And no you can not merely add your fiancé to the birth certificate, he will have to adopt the child, which requires contacting the real father
