I am a single mom (34), and I would like to seek legal advice on child support and abandoned child rights protection.
The father of my son has abandoned our child and deprived him of his right , as well as financial support from day one.

And because support was not defined and consistent, I was forced to go back to my parents home and asked for their help. Eventually, things became worse when we were not able to contact him anymore. And so after 18 months of waiting, a family friend suggested I seek legal help on child support.

But since legal advice requires money and an attorney, and what I earn a month as a call center agent was just sufficient for me and my son's needs , I decided to wait and save. Surprisingly few months after, I received a call from his father, apparently, a common friend knew the family and he was told about our situation.

We spoke on the phone and he asked me to meet him for coffee, I came with my dad and we were told that since his son is out of the country, he will be taking care of things for him. That week he told me that he has scheduled DNA testing at Makati Medical and he will be calling me when the results arrived.

Three months later, he called and asked me to meet him again so we can talk about how much support my son would be needing. In the meeting He said that he would be giving Cole, my son P20,000 a month in behalf of his son.

Fyi: My son's grandfather was a senator that time while the father of my son was also a government official in Cebu, unfortunately due to a drug related incident he got himself in, he lost in the election and his devastation resulted to drug use and dependency.

We have been receiving the said same amount from that time on till 6 months ago. Occasional delays on the side were usual... But what breaks my heart is the fact that he has not contacted us again till now. And that my son does not receive anything more for birthdays, Christmas, school tuition, and other food and clothing needs.. etc.

I would like to ask for legal advice on this matter. Thank you for your time .

First, its not a good idea to piggyback your question on another thread. To avoid confusion I've moved your post to its own thread. I assume because the other thread was about the Philippines that is where you are located. Second, it is not a good idea to post personal contact info on a public site so that has been removed.

So, if I understand this your child's grandfather agreed to pay support for your child and was paying up until 6 months ago. Was there any documentation for this payment? Was it approved of by a court?

Unless you have a written agreement, preferably court approved, then the payments were gifts that can be stopped at any time. You can still go to court to get an order against the child's father. You don't need an attorney for this. Family Courts are more user friendly. But if the father is not available, it may be difficult to collect on the order.

You could try suing the grandfather if you can prove his agreement to pay, but that is an even longer shot.

I'm sorry I don't have good news for you.
