Hi, if I had a visa (f2) and lost that visa does that make me not eligible for deferred action. Most lawyers tell me that because I lost f2 that USCIS will not grant me deferred action. Thank you for your help!

"Most lawyers? How many have you asked?
Without knowing all of the circumstances I would believe them.
Did you put it somewhere and can't find it? Something else?
EDIT: Please stop opening new threads on the same subject. The answers don't change depending on how many times you ask. Our Immigration expert explained the situation to you in a very clear fashion. What is it that you don't understand?

By lost I mean that my F2 status became void. I asked lawyers on a website called avvo and 2 specifically told me that I would not be granted deferred action. The rest either told me to call a lawyer or implied that I was not eligible for deferred action. I know that the immigration expert replied but I became confused when USCIS asked me to prove to them that I do not have F2. Your post helped me a lot so thanks for the reply!

In order to get the best answer, you must provide all info, from date you entered US, type of visa, how you lost your status, when, etc.
Most people make their situations worse by asking one line question.

Here is more information: I came to the U.S. on a F2 visa in September 1989. I was a dependent of my father who had F1. My F2 status expired in January 1999due to an overstay. In 2005 (around February) I applied for F1 and it was denied later in the year around November. USCIS explained to me that since my F2 visa expired I was not eligible for F1. Last year in Septmember 2012 I applied for deferred action. In April of 2013 USCIS asked me to submit more information that would prove I have not left the country and that I had no lawful immigration status. Currently I am waiting for USCIS to make a decision on my case. Thank you for your help.

At what age you entered US as F2
What happened to your father? What is his legal status right now?
What documents have you submitted to USCIS?

I was two years old when I came to the U.S. My father is a permanent resident now (green card) after my sibling filed for him when he became 21. I was not on my father's adjustment. I gave USCIS monthly bank statements and my transcript (4 years) to prove I have been and not left the U.S. I gave them a copy of my father's green card to prove to them that I no longer have F2 status.
