It's legal in WA. It's my son and he didn't smoke in front or his daughter in the same room. He is not neglectful in anyway. However, the Mother was arrested for DV and had to go to alcohol classes as a part of the probation period. Now she had taken my granddaughter to Tennessee w/out letting him know and he's trying to get the courts to make her come back. He had already filed custody paperwork (parenting agreement in WA) but hadn't had time to serve her. So now this is the ammunition that she feels she can use against him.

Not according to Federal law, which still applies in Washington state, last time I checked.

Were they married? Is he the legal father? Did they get divorced? Was there court ordered custody or visitation? Does he have a prescription for marijuana?

They were not married. They are in the middle of a Parenting Plan. She took the child and moved to Nashville against his wishes after the summons was filed. He is the legal father. They passed a WA state law legalizing Marijuana at our last vote. No he doesn't have medical card. I had read something, somewhere, previously that said that Marijuana smoking was no different than drinking. She's had to go through AA classes after her Dom Vio arrest
