I have been living in the house I'm in four four years rent free because it belongs to now my ex boy friend he wants us out and has even served us a notice to vacate which has passed I know he is going to evict us but I need to know what to expect and how long I have to get out I have two children at home and a 6 week old grand child here what are my rights I have been trying very hard to find a place but since I haven't had to pay rent I have no history of paying rent

Depending on where you live - he must give you 30 day notice to vacate (which it sounds like has already passed). If you have not moved out by the end of the 30 days his next step is to get a court order to evict you, and then have the sherriff come to enforce the court order and remove you and your belongings from the premises. This may take about a week or ten days after the 30-day notice period is up. Obviously time is running short for you, so I would strongly encourage you to make some interim arrangements - such as staying with family or friends until you can find a place of your own - because one of these days you are likely to find the locks changed and your possessions piled out front.

If you were served an eviction notice... and that period has passed... he can go to court to have the eviction enforced... after which the Sherrifs will come and put you and your stuff out on the curb.

You have no other legal rights than any other non-paying tenant would have.

Best to get off your butt and find another place to live... ASAP, you don't have long. The time for excuses is past.

You think it is hard finding a place with no rental history? Imagine how it will be with an eviction on your record.

The ONLY right you have is to legal notice and a hearing for an eviction order. But you really don't want it to get that far.

An ex who wants you out would surely give you good references? Have you asked him? What was your living situation before 4 years ago?
Have you checked with social services, welfare, any agencies at all?
What stage of the process is it at?

As others have said, might be a week or so, but to know exactly, it depends on how busy the courts are in your neck of the woods.

I would be best to immediatedly find a place, perhaps month-to-month for now, and then tell you ex how soon you can be out. Tell him that you are doing your best to be out ASAP and perhaps he won't feel the need to take you to court.
