View Full Version : [401k withdrawal] Filing 1042S tax form

Hi,

I was on H1B Visa, before I quit my job and moved to India. Later I withdrew my entire 401k contribution in 2012 for family maintenance purposes and they withheld 30% as Federal taxes.

Now I want to file my tax returns and have 2 questions to clarify:

1. Firstly, I just saw that last date for filing individual tax returns was 15th April'13, but because of delay in getting 1042S tax form from Vanguard (my 401k company), I was unable to meet the deadline.

Can I still file my taxes ? (while I'm waiting to receive tax form)

2. Secondly, how do I go about filing 1042S tax form using some of the available online tools such as turbo tax.

Please clarify.

Prakash,

Because you are in India, you have until 15 June 2013 to file.

You may want to file as a resident for 2013. Filing dual-status is the alternative option.

Either way, you must also submit a Residency Termination Statement.
