My father in-law was stopped for no seat belt with his two daughters who are 23 and 16. He was asked to take a breathalyzer and he agreed. First test was .08 which is the legal limit was asked to blow again and blew a 1.0. Before being transported to the hospital the officer was asked by the eldest daughter how much the bail would be "you guys wont be able to afford it" was his reply when asked again " well how much will it be?" he replied "$3000.00". At the hospital his blood test results were .06. He was arrested for DWI,open container, and no seat belt. When family went to post bail the officer pulled one of the family members into his office alone and told the family member, "you know, I can be a jerk and add child abuse to it." when the family member replied " you are the law you do what you have to do." the officer said OK there is no longer bail I'm adding child abuse. He has spent 10 days in jail after his arraignment and now is being held by ice as of today. Family members were told to pay $5000.00 within 24 hours and he would be released. If not he will be deported within the following 24 hours if not paid. With all cases still pending. WHAT TO DO

Told to pay $5000 to whom?
I would go down to the court house and say you want to pay the money and to whom do you pay, just to find out if this is possible, and to stall for time.
But you really need a lawyer to handle this in person. There is nothing you can do for free, because they can deport him regardless.

Police can't deport anyone overnight. He would have to finish the DWI case first, and then he will be held by ICE. He can contest deportation in court. Consult both defense attorney and immigration attorney.
