In the UK the relevant law is the Sexual Offences Act.

Penetrative sex with someone aged under 13 is defined as rape whether consenting or not.

Whether the 13 year old will go to some sort of youth 'prison' or not, or for how long, or how many years he might be on some sort of parole or program, will be a decision by the court.

Just some additional information:
If a child aged 13, 14, or 15 consents to sex it isn't deemed rape, but you are guilty of 'sexual activity with a child.' Sex with a child aged under 13 is always rape. Although the phrase is not used in the law itself, this is often called 'statutory rape.'
If two 14 year olds have sex they are both, theoretically, guilty of sex with a child. But in this kind of circumstance prosecution is unlikely. Note the HUGE difference between 12 and 13.

(This same question was asked on March 23 by this ID minus the 1, and people thought he was a troll because of the lack of concern by parents when they slept at each other's house. Now it appears that he might be seriously a 13 year old with a genuine problem.)

It is possible to be locked in a youth detention home or put under some form of court supervision.

In the original post he claimed it was the girlfriend who wanted this so he may have ignored our advice to resist. If, in fact these parents are allowing sleepovers, they can also get in trouble and might have both these children removed from the homes.

To scott I did lose my account but when I did I left it for a week or 2 and made a new one and me and my girlfriend had a conversation and I told her the risks she would have put me and her in and I also said that we are to young for stuff lik that and if it comes to it you will have to leave me and so I set this new question to see what would have happened if I did take that risk and what would have happened

You might not go to prison but you could get her pregnant. Do you have a good enough job to pay tor a baby?

OK, I will accept that. But I will repeat the comment I made in the other thread and ask you to address it.

I'm going to be frank here. I don't believe your story for a moment. I can't imagine the parents of any 12 year old girl who would allow her to sleep over at any boy's house.
