Hi,

I am an Indian national on F-1 OPT status since June 2012 and in US since August 2010.


I had two questions on form 1040NR-EZ:

1) Do I enter actual days of presence for each year in ITEM H (second page, form 1040NR-EZ) or "0" due to my F-1 status since arrival? In Form 8843 it was pretty clear due to two separate questions in this regard - days of presence in each year from 2010 to 2012 (Part I 4-a), and days I claim to exclude in 2012 (Part 1 4-b).

2) In ITEM J for Indian nationals, what do I enter 1b, 1c and 1d - because I am not exempt from compensation gained during F-1 OPT but the standard deduction is the exemption I get, is that right?

So, I am not sure about what I should be entering in 1b, 1c and 1d.
And, should I be entering anything on Line 6 on page 1 of the form?

1) List the actual days present.

2) Your treaty exemption amount is $5,950, the standard deduction.

1a) India

2a) 21(2)

3a) Enter the number of months you were in the United States prior to 1 January 2013.

Leave Line #6 BLANK.
