I just found out I have a 19 yo daughter and now the mother is asking for child support. Is there a legal obligation? She have never told me prior to now I was the father?

What State are you in? If it was never filed by now it is unlikely that she can file unless your state allows for it. Some states have child support through 21 years of age.

Any question of law needs to include your general location as laws vary by area.

The mother is not entitled to any ongoing support. However, she might be entitled to retroactive support depending on local laws and the circumstances. For example, if the mother received public assistance, the state will want to be reimbursed. Its also possible that the mother received a curt award for support, but couldn't find you to enforce it.

We live in California and the child was on public assistance. Will the state ask for back pay for 18 years and how much will I have to pay back?

What was the child on public assistance for?

How much was paid out in public assistance? What did public assistance pay for?

Was the child eligible for public assistance?

Are you the child's father or mother? Did you pay child support?

Why are you asking if you're responsible to pay for the public assistance? Are you being asked to pay it, or just worrying about the future?

I am the father, the mother was on California welfare system. I don't not know how much she got monthly. Mother is saying she will take me to court to get back pay $ for child support. I never paid child support because I didn't know I had a child until now.

It is out of her hands. Unless there was a order against you it is too late now. The only time that changes is if there were evasion taking place.

First, if you had posted as a reply to your original thread, instead of starting a new one, There would have been less confusion. I've now merged your threads.

She apparently doesn't know the law any more than you. CA law only permits retroactive support to when the non custodial parent is served. Since she can't file now since the child is over 18, if she never filed before, that boat has now sailed.

I don't know if the state will go after you at this point.

We can't predict what the state of Calif will do. It is up to them.
