View Full Version : Can landlord go in apartment for inspection with 24 notice?

Hello, I am a new landlord, and I unfortunately rented to the wrong tenants... Well anyway I ended there lease and they signed it saying they will move out march 2 and I called them today to see if they are moving and they said no that they did not find an apartment... I also here banging upstairs where they live above me, so I like to inspect the apartment... Can I go in apartment to inspect with 24 hour notice even if they are not home? I also have to evict them Monday.. Can I sue them for lawyer and court fees? And put it on there credit report? I am very nervous and didn't want it to come to this hoping they didn't damage anything... thank you Christine.

Tenant law is by state, province, etc. Where are you?
What exactly did you do to end the lease and what was the term of the lease?
Do you have March rent, and do you have a security deposit?
You are going to have to evict, formally, according to the procedure at your county court house.
If you hear banging, go up there and bang on the door and walk in.
If they aren't home, let yourself in, and claim an emergency. Leak in ceiling, whatever it takes. You are fighting fire with fire at this point.

For us to help, you need to provide more info as Joy notes. Also did you get and check references? Get a security deposit?

As for inspection, what does the lease say? This is usually specified in the lease.
