Hello All,
I have been sweating bullets, I am this close to filing but I am trying to be very honest and truthful about whatever I put on the forms.
Came here on F-1, F-1 expired, fell out of status , met wife (U.S Citizen) dated for a yr.. . married for 4 yrs. Now in NM. We have a daughter together. Never applied for I-130 and I-485, been financially incapable, since I cannot work and she bore all expenses. She lost her job, due to which we lost our lease at our house of almost 5 yrs. Lost our car, she had to move in with her mom with our kid. Mother-in law is very supportive but only to an extent. Wants us to fix my status so I can provide for us (wife and daughter).
I reached out to my distant family in NJ, who agreed to finance my paperwork and provide me a home until I fix this mess. Have all the necessary documents to prove a bona-fide marriage ( Affidavits signed by friends, church, marriage certificate, previous lease agreement, daughters birth certificate, pictures)
But I-130 asks for Address where the immigrant intends to stay: of cource I can put my mother-in -laws address once I can be eligible for EAD and contribute and provide for my family and rejoin them in NM. But I-485 asks for my address, I am currently living with my side of the family in NJ who are helping me finance the immigration forms and lawyer fees...
Would filing I-130 and I-485 along with my I-765 concurrently cause an issue since I am being truthful about my addresses ? We want to be very truthful about this.
P.S : We love one another, we have delayed this much too long, we want to live together once I am able to work and provide for my family as well, its just that we're poor.
