View Full Version : Can I have my sons fathers parental rights taken away in North Carolina?

My son is 7 years old. I have no court order stating I have primary custody. And I have never filed for child support. His father hasn't been a part of his life since he was 3. He has never given me any money to help support him nor have I ever asked. He hasn't tried to come visit him in 2 years and the 2 years before that he would say he was going to come but would never show up. He has been to rehab and in jail a few times. I am not looking to have him adopted by anyone else but I want to be able to make sure if I die I would be able to leave him to my mom. I don't want him to have any legal rights to him. We live in North Carolina. My question is how can I go about having his legal rights taken away. He will not consent to it because it will make him look bad. But he isn't ever around anyway. I need help. What can I do? Can I have his rights taken away?

No... can he have yours taken away.

Until that child gets adopted... he's got the same rights you have... like it or not. There is nothing you can do about it.

Courts are very reluctant to issue a TPR. It is unlikely they will issue one in your circumstances.
