View Full Version : What are the concequences of a failed ignition interlock breathalizer in MA?

I have had a breathalizer in my car for over a year now with no problem. Today, however, I started my car with a passed test. I sat in my car waiting for it to warm up and in the meantime, I sprayed the windshield washing fluid for quite a while. After 5 min, I had to retest, and I failed the test. The devise locked me out for thirty minutes and I had to retest again at which time I passed the test. The device read "lock out in 2 days" so I immediately called my interlock guy. He came to my work and did what he had to do, but the reading was 0.055. And he told me that I would get a letter from the registry for a hearing. I don't drink and haven't for 8 years now. I am a certified alcohol and drug counselor.( imagine that) when I got back to work, I immediately had the nurses give me the alcometer test which was 0.000 so my question is, what can the registry do?? Will I lose my license again?? Do they understand that windshield wiper fluid can give a false reading?? Thank You for your input

I don't think that spraying windshield wiper fluid on the outside of the window would cause a false reading on an interlock.

Also, you have me confused about something and maybe I am looking into it too far but I have to ask... Why is it that you have an interlock device on your car? You haven't drank in 8 years and you are a counselor... am I missing something?

I have an interlock in my car because I was convicted of a 3 rd oui in 2005. I went to jail for 6 months and I lost my license for 10 years. After 6 years of not driving, I received a hardship license with an interlock device. And yes I am a LADC and CADC. I went back to college in 2006 and have been a counselor since 2007. I was told by my interlock rep that windshield washer fluid can definitely affect the breath test, especially with the defrosters on. Like I said, I passed the test initially, 5 min later I failed the test and 30 min later I passed the test with 0.00. However, since the results were over .05, I will be getting a suspension letter from the registry.

You'll need to hire an attorney to challenge the results. Simply you saying so, ain't going to convince them you didn't drink.

I think that the regestry will c the results from my interlock report. Can a bac of .055 go down to .00 in 30 min?? My interlock rep was with me when I retested in 30 min so he knows that it was me that blew into the machine

I understand you have evidence.. I'm talking about a venue where your evidence WILL be considered... It won't happen because you say it, or write it to them in a letter, or get notarized statements... NONE of that will stop them from REVOKING your license.

Sorry, but I left my crystal ball in my other clothes.

I have no idea whether they understand that, if it's true, or not.
