I am having a problem with my ex husband neglecting his 6 year old son. At random times he leaves his current residence and disappears for an extended about of time. The first time was about 4 months, second time was for 1 year, and the third time has been 4 months so far. He never calls to ask to talk to his child or even asks how he is. The only time he tries to contact me is when he is in trouble. I do get child support, but it is paid by SSI. Can I charge him with abandonment or at least get his right revoked?

I take it you are not living with your ex; he is living somewhere else, you have full custody, right?

It isn't abandonment if he is living somewhere else and if you and he are divorced, which I assume you are, then he can just about go anywhere he wants as long as you are receiving child support.

So you can't charge him with abandonment because it isn't that. If he is the bio father then he has just as much rights to his child as you do.

Sorry, but you can't just have his rights revoked.

You can't charge him with abandonment. Because he hasn't legally abandoned your son. And you can't get his rights revoked on the basis of his not being an active father.
