View Full Version : How do I reply to a court summons

I live in MA and I rcvd a summons today from a local atty for - Cavalry spv llc.BOA/FIA - I am in default due to disability and divorce - (on Social Sec what it says I owe. The letter ialso says I am further indebted to plaintiff for contract interest charges.
How do I respond to this summons -I do not have an atty nor can I afford one hopefully I will be filing bankruptcy next month (money permitting) should I tell them this?

Sorry - My info was cut off - I do not believe I owe what they say I owe - but they have asked for interest and costs (there amount is off by 10,000 - unless this is interest to date?? ) Desperate... THANKS

What is the debt for? If you believe you do not owe this debt then you file an Intent to Defend with the court citing your belief the debt is not valid.
However, if they filed suit before you filed for bankruptcy there may be an issue with discharging that debt. If you have already filed, then part of your response is you have filed for bankruptcy listing this debt as one of those to be discharged.

Hi Scott - this is credit card debt - Brankruptcy can't be filed until I finish paying atty - since I got divorced living on SS money is tight. Any suggestions on how to proceed. Many thanks

I told you how to proceed. Respond to the summons with an Intent to Defend.
