My husband is an illegal immgrant and we been married for 2months and we have a five year son and we don't live together so I'm just wondering how I should file my taxes. My taxe guy told me if I claim my husband that my returns would be a less amount than what I'm use too. So what the best way to file my taxes..? And plus when my husband use to do his taxes he always had to pay but I have never had to pay.

You don't 'claim' a husband. You either file a joint return or a married filing separately return. And how much you save doing that depends on how much each of you makes, so usually you plot it out both ways and decide which one works best.

The IRS doesn't care if your husband is illegal as long as he pays the taxes he owes.
Usually filing a joint return is the best option.
If you id not live together the last 6 months of the year you are filing for and your son lives with you, you might be able to file as head of household and he would file married filing separately.
As joypulv said, calculate your return for all possible scenarios and choose the best one for you.

If you file jointly, your husband will have to get an Individual Tax Identification Number (ITIN), which will make your return ineligible for the Earned Income Credit.
