View Full Version : How to file state tax returns while applying TIN for my spouse

I am applying ITIN for my wife along with my federal returns. How do I file tax returns for state - I have to file for MICHIGAN and MINNESOTA. I don't have much time left to wait till I receive TIN and then file the state returns. I want to know if I can file state returns without TIN or simply attach the W7 form along with the state returns and file it.

You MUST WAIT until you receive the ITIN before you can file either state tax return.

Sending the returns in without the ITIN will only result in the tax returns being rejected.

If you have refunds coming from both states, do not worry about filing late. Penalties occur only if you owe taxes.

Thanks for the help.

I had just referred with my friend who filed through HR-Block. In the MN filing form, he had printed 'APPLIED' in the space for spouse' SSN and his return has been accepted. I have done the same. However, I am planning to file the MI returns only after I receive the TIN. I am getting a refund in all the cases - Federal, MN and MI.

If Minnesota accepts such returns, they are unique among the states.

However, it does not surprise me. When it comes to taxes, Minnesota marches to a different drummer than the other states.
