My son is 13 yrs. Old and his biological father left us when I was 5 months pregnant . He has never paid a dime never met my son , we were married when he left and I divorced him after my son was born . I now want him to sign over his rights . My question is does he need a DNA test ?

You can't get him to sign over his rights... not unless you are getting someone to adopt him.

Yes I know and that's what we want to do . My husband the man who has raised my son since he was 2 wants to adopt him... That's why I'm asking does he need a DNA test!!

But you didn't tell us that in your post. And it was very important. But we know it now.
He might because to sign the adoption papers he will have to establish he is actually the father. The Court would make that request if they need it... I assume he is willing to do it.

So he might need a DNA test even though biological father is on the birth certificate ?

Possibly... quite often the wrong person is on the birth Certificate... but in this case he really is the father... the court would likely order it if there is ANY question about paternity... but if he is willing, and he will HAVE to be willing to allow the adoption... then it's a simple procedure to do...

Don't worry if they ask for DNA then... its simple and not a big issue... and since adoption is a lengthy procedure... the extra week or so for results will be hardly noticed.

Right! I was just wondering . It's been a long 13 yrs waiting for this ! I just want it done ! I have nothing to hide or worry about . I just wanted to make sure he wasn't lying . I mean if he feels he needs it then he can get it but I just thought it was unnecessary . :)
