View Full Version : What can I do? Gave a typed letter to rental company stating I would terminate my lea

Gave my rental company a typed letter explaining my frustration about mice in my apartment. They agreed to let me terminate my lease early, and sent a early termination of lease agreement that I did't turn in, because the mouse was caught, and the problem was abated.

The typed letter stated that I would be terminating my lease in 60 days, but I put a strike through the 60 days and hand wrote 30 days over the 60. I was still seeing mice droppings after giving the 30 day notice, I was extremely frustration and the City Health Inspector was involved and assisted me with getting the problem abated.

So, today I received a letter from them saying they are honoring the 60 day request and are expecting me to move on November 30, 2012 or I would be considered a "hold over tenant" and that would make me pay two of times the daily amount of rent. The bottom line is I didn't give a 60 day notice, and did not plan on moving at the end of this month.

Hello dd:

Write them ANOTHER letter and explain what you said to us, and tell them WHEN you'll be moving. Send your letter CERTIFIED, return receipt requested. Then MOVE on that date.

If they think you'll owe them money, they'll keep your security and probably sue you... If you think you DON'T, and they don't return your security, you should sue THEM.

Excon, if I'm reading correctly, OP doesn't want to move out at all, since the mouse has been caught and the problem solved.

Ddcarter, when did you send the 30-day notice?

On, September 6, 2012, they responded with allowing me to terminate my lease move-out on September 30, 2012 if I would chose to.

I was given a week to turn in the learly termination form which I didn't, because the rodent problem ceased.

I believe they are really pissed-off with me, because the city made them exterminate the entire 30 unit bldg, and also the perimeter and underground parking structure.

Basically, they are making me pay for reporting the problem don't understand how they can turn a 30 day notice into a 60-day notice!

If I did't move in Sept. why would I decide to now?

I STILL don't know if you're going to move... But, you don't have to tell me.. You have to tell your landlord. If you're NOT moving, then let them sue you and explain it to the judge.. It's ONLY going to be handled in court..
