I have married and I have 2 small children the father of them never signed the paper in the hosptial when they where born so they had my last name he hasn't seen them in over a yr because I won't let him cause he has a very bad drug problem and in and out of jail but my husband would love to adopt them, they call him daddy and they are 3 and 4, how hard would it be for him to adopt my babies and how would I go about doing so?

You actually made it harder by not putting the father on the birth certificate. Before your husband can adopt the children, the bio father needs to be identified and his permission for the adoption given.
If the bio father refuses, in your case, you may get a court to override his objections.
You NEED an attorney to make sure this goes properly. So that is your next step. Interview some Family Law attorneys and choose one to guide you through the process. Your attorney will prepare all the paperwork to submit to the court.
