I have a neighbor that we are have a disagreement with, he put up a partial privacy fence and proceeded to take pictures of my son saying he was trespassing. The law enforcement officer was called and during this visit we found out the neighbor took pictures of the inside of my home without our permission. Is this illegal?

Not really if they did it without tresspassing. You might want to consider getting curtains, blinds or even sheers on the windows on that side of the house.

He didn't do it from outside he did it when he was a guess.

Then I would say no... as he was invited into the house. And I've takens lots of photos at various events inside the houses of others over the years.

I'd just let it go... and not let it bother you... its easy to escalate things like this and it only makes life more difficult. And trust me... I've dealt with neighbor issues on a number of occaisions over the years.

One of them resuled a threat of an arrest... another DID result in an arrest... one resulted in a D&D chrage and later them selling the house and moving away... and one other that has been ongoing for decades... and progressively making things worse for the other party who started it all...

Sometimes you have to stand your ground... but others its easier to let it slide. I'm one of those people who you either love to be around... (for the nice people) and their worst nightmare (if they try to strongarm me)
