I was with a friend who overdosed on heroin about a week ago. I ended up having to give him rescue breathing until the ambulance showed up. I noticed a bag of contraband and drugs in his truck and threw it in the bushes. The cops arrived and questioned me, and ended up finding the bag. I know my fingerprints are all over the contents and the bag. In addition, there's an empty bottle of xanax in the bag with my name on it (I have a script). I told them I didn't know anything about the bag. The cops have called my cell phone, but I missed the call. Should I be worried?

If your fingerprints are all over the bag, why did you lie about not knowing about the bag? (and why dispose of it where someone else --a child? Could find it?)

I would worry if I were you.

Because there were still drugs in it. I wasn't going to leave the bag there... once the cops left, I was going to pick it up. The paramedics said I saved my friend's life via the rescue breathing, and did the right thing by calling 911. I was literally freaked out... the bushes were the best spot I could find.

If a bust that small fell into their laps, they'd probably pursue it.. But, they AIN'T going to take the time to do a fingerprint analysis for a simple possession beef.

I'd talk to the cops, if they call, but sparingly and defensively. If you get ANY inkling during the conversation that the cops want to bust YOU, politely tell them the interview is over, and if they want more information to contact your attorney..

That should end it.

I disagree there. Even with a lawyer present it could be a mine-field.

I don't recall any instruction in law school about how to guide a client through that minefield. I don't think there are any.

And, by-the-way, the story you told us doesn't even ring true. Why, for example, did you put your empty prescription bottle in the bag? Just doesn't make any sense.

Let me see, you were there with your friend, he was over dosing, so you got worried,not about his life, but about hiding drugs. ** that is the way the DA will tell it to the court.

They don't even need to check fingerprints, since they have your bottle with your name on it, with the drugs.

I would be seriouslly worried, since if the prescription drug is in his system, it is no longer possession, of it is distributing the drugs, you provided it to him, and makes you a dealer.

This is a easy case and yes I assume they will arrest you shortly.

I will drink to that. Great to live where all the pain pills are legal without prescriptions, there is no drinking age limits, and sports gambling is a national pastime.
