View Full Version : I filed a form 1040EZ instead of 1040NR.

I have a J1 visa and came from Korea.
I had a CPA agent do my taxes of 2004.
I found out that he made a mistake and sent in the wrong form. My agent sent in a form 1040EZ form; however he should have used a form 1040NR form.
Because I worked in U.S. for 3 months in 2004, I was refunded all Federal tax even though he used a form 1040EZ form.
But I didn't receive Medicare and social security tax refund. :(
When I read your web site, I can request my Medicare and social security tax. Should I report 1040X with 1040NR, 843 and 8316? I didn't understand exactly about a form 843 and 8316.
I need your advice! When I file an amended tax return, should I fill out a form843 and 8316? :confused:

File the Form 1040X with a 2004 Form 1040NR and 8843 FIRST. Once the IRS processes rhe 1040X, you can then submit Form 843 to request the refund of Social Security and Medicare taxes.
