View Full Version : Expired judgement leaving a lien on property

I filed a chapter 13 bankruptcy in approximately 1999. By a mistake, one judgement survived the bankruptcy that I successfully completed. The judgement caused a lien on my property. I became aware of this while trying to secure a Home loan in 2008. After contacting my attorney he advised me that the judgement was only good for 10 years if not re-filed by the creditor. And that if I waited the ten years the lien would no longer be valid. It was never re-filed and is no longer on record as being a valid judgement. I now have no judgments against me, but the original lien still shows on the property records. I want to sell the property now and need to have the lien removed. How do I do this.. I live in Indiana county of Cass.

If, as you say, the judgment lien has expired, the buyer's attorney will recognize that this exception on the title insurance policy is of no significance. In other words, it shouldn't affect a sale.
