We purchased a trailer that has been on the same lot for over 12 years in Pike County KY, (Pikeville). The owner of the property was fine with everything when we moved in and we paid our lot rent to the lady we bought the trailer from until it (trailer)was paid off in March. (Have all receipts) Then the lot rent was paid directly to the property owner where the trailer sits.
Now we have an issue with our neighbors and the owner gave us an eviction notice (no lease) saying there was a septic issue. Heath department was called and came out and inspected our septic lines and said it would pass inspection and that everything was OK. Does the landlord (property owner) if matters are taken to court need to reissue another reason for an eviction if the health department has OK'ed the septic. However, after reading tenant handbooks it clearly states that the landord should be responsible for this in the first place. We should be able to recoup our expenditures in withholdng lot rent with providing receipts to owner as well. (The septic was never hooked up in 12 years previous until we moved there) We were also told by the previous owner if we tried to use the septic that the owners would try to force us out. Kind of some devious stuff going on here. Can they use this matter to evict us under KY law?
