Hi

I am an international student studying in the US on F-1 visa. My 5 year visa expired in June 2012 so I needed to renew my visa for which I came back to India and applied for F-1 visa renewal. I was arrested for petty larceny(30$) in May 2012. I did a very stupid thing and due to no prior criminal or bad records the court agreed to grant me ACD in six months if I stay clean. I was not convicted of petty larceny and case will be dismissed in six months.

While applying for the US visa application I was uncertain how to answer the question were you ever arrested or convicted as my lawyer told me that we got rid of the case and you should answer no if a question like this pops up in any future forms and I answered that question with No. I got an email from the US embassy yesterday requesting for my arrest records. I will submit the documents regarding the arrest and also documents stating that I wasn't convicted and the case would be dismissed in June 2013.

I am really really worried as I just one more semester left to graduate. Can the embassy reject my visa on any grounds. Will this case come under CIMT as I wasn't convicted and my case and records will be dismissed and expunged in another 4 months from now.

Kindly suggest me something. Any kind information would be of great help
