My sisters is getting a divorce and her husband is a convicted sex offender for sexual assault 2nd degree on a minor girl. Is there any way he can get custody of their son. And he wants to split the children up can he do that?

Can he ? Is she a drunken hooker that hits the kids ? Or a Sunday school teacher or something in between.

Is his sex crime about children and is this child in danger, if she allowed father to be around and care for the children while together, it shows she see's the father as no threat to the child.

He can ask for it, doubt he gets it, but may well get partial custody, or at least visitation

No she is not.. She a wonderful mom. She is the one that is always with the kids. He is never around.

There is no way to predict what a court will do. But courts are charged with ruling in the best interests of the children. So I find it hard to believe a court will allow him to split the children.

I've never understood that aspect of either version of The Parent Trap. :)

My last family court judge was in the middle of a bad divorce and acted fairly well like all women were evil blood suckers. I liked him when I went to court the last time.

One time it was a women who was a homosexual and thought all men were worthless sperm machines.
** or so my lawyer told me.

So justice often has to deal with the opinions of the judge in many matters.
