I am on a section 8 voucher. I have lived in my apts for three years. My lease is up August 30th. According to my lease, you have to put in a 30 day notice.
I was advised after I put in a 59 day notice, that when you are on section 8 vouchers, you don't have to put in a notice. Also, section 8 will not be finished processing my papers for me to move until after September 4th.
Now the apt complex wants me to sign a month to month, and pay them full price. What I need to know, is if my 59 day notice is binding, and will section 8 continue to pay their portion of my rent.

Where? I know it's a 30-day notice (or the same period for which you pay rent) in Caifornia.

I find nothing that says Section 8 does not require notice.

The apartment complex cannot and does not have to rent out your apartment on any day other than the 1st, if that's how your rent is due. If you stay on 4 days (or, for that matter, 1 day), the complex "probably" cannot rent your apartment for that month and will lose one month's rent.

Yes, legally they can ask you to sign a month-to-month lease and collect rent if you are not "out" on the 1st.

Yes, your 59-day notice is binding BUT you still have to be out on the first.
