My husband has a 13 y/o son who is Autistic from his 1st wife. He has been living with us since school let out in June. His mom has lost two places to live in the past month. He is registered for school at our house. His mom has 7 people living in her home (2 br apt). She is mad at my husband because we had a meeting at school and he did not tell her. The meeting came up quickly and honestly we did not think about it. The child is doing so well in school and all of his teachers are commenting on how different he is this year with us than last year. His mom has been evicted 9 times in 3 yrs.

His mom told my husband that she is coming to get him even though she has no place to live after Tues, which is when they have to be out of the apt. What can we do. They have joint legal custody, she has primary. She has never taken him to any of his doctors appts, and will not get his meds or anything. We have to do all of that. We also do everything at his school as well.

You need to go to court for an emergency hearing on custody.

If you have visitation and do not return the child when required, by custody agreement, you could be in trouble, You need an attorney NOW.

File an exparte motion for custody and explain as to why it is an emergency to cause such a change. You will need to provide evidence of what is happening and supporting documents to prove your case.
