View Full Version : How do we get out of a buyer broker agreement?

We made an offer on a house a few months ago. It fell through. As part of that offer, our realtor had us sign a buyer broker agreement. Now we are looking in other areas that he is not familiar with and has refused multiple offers by local realtors to pay him 25% of their commission, but he insists on sticking to the original buyer broker agreement. He cannot supply MLS information for the area we are looking in. He really is unable to help us-and he is getting pushy and rude. We find all the houses we want to look at online without his help. We drive. We buy lunch. It's a losing proposition for us.

An agreement is a contract. The contract is valid and enforceable unless/until it expires or you negotiate different terms.

Of course he can supply your MLS listings for anywhere in the US where there is listings.
He can access a national data base. Tell him that he has to supply you these, if not report him to the real estate commission

You actually signed a buyer agreement with no locale definition and no end date?
The standard forms have blanks for filling those in. What does yours say?

I'm thinking he's an independent - common in my area. Multiple listing realtors prefer not to deal with them.
The realtor may be hitting a brick wall when it comes to listings outside his company.

Thanks. I have asked him - repeatedly - to supply MLS access for the other area and he suggested realtor.com, that's what he uses. He also suggested AZmoves.com. When I said I wanted actual MLS access, he finally provided a canned search that did not have up to date listings. He said he did not have access to all of the listings that the local realtors have. He blames the local realtors for not giving his MLS site, full access to all of their listings. Other realtors can supply access with that search tab that allows us to change the search criteria, he said he is working on that but has been unable to provide it - for about 3 weeks now. Nothing yet.

How long does your contract with him last, how much longer? (How's that for a backwards question?)

It ends in September.

It sounds like he does not pay the fee and have actual MLS access. If that was promised in the contract, he may be in breach.
