View Full Version : Can I take my son's biological father's name off his birth certificate?

My son's bio. Father fled the country one month before my son was born. He hasn't bothered us in what is almost 4yrs now and has never paid child support but now he stalks us. My son is entering preschool this fall and I worry because the hospital made me put his fathers name on the BC but the bio. Father never signed the because. Can I take him off if my current husband wants to adopt?

No, he would have to agree to the adoption too.
I hope you filed for child support years ago.
You should hire a lawyer for this potential problem if he is stalking.

First you need to tell us where you are at, the laws in India is not the same as France or the same as the US. Laws within the US vary by state.

I ask this, since normally you are not ever required to list the father, and the father is not added if he was not present to sign.

So depending on where you are at, if the hospital illegally forced you to list him or having him on it is improper if he was suppose to sign, there may be ways but this depend on exactly what happened and where.

In general no once the father is on the birth certificate you can not take him off without the fathers permission or a court hearing where you show it is in the child's best interest

I,live in the state of Michigan but when the nurse told me I had to put his name down because we were recently divorced our marriage lasted less than 30days and the divorce 8mos it was finalized one month before my son was born which was the same month he fled the country.

If you were married when you conceived, then he is the legal father and that is why he had to be listed.

You need to consilt an attorney to process the adoption. You will have to make n attempt to get the father's permission for the adoption. But in your circumstances it may be possible to override his objections.
