View Full Version : Verbal Contract for Rent Left Unfufilled

Last October, my ex-boyfriend and I broke up, and basically kicked me out of the apartment in which we were living with another couple. I continued to pay my portion of the rent ($585) until the lease was up in January, so that I would not have any reason for the rent to not get paid, given that my name was still on the lease.

In November, my former boyfriend lost his job and asked me to help cover his portion of the rent and bills until he was able to pay me back. I paid both of our portions of rent for December and the prorated portion for January's rent (the month in which our lease ended).

It is now August, and I have not received any payment, and when I contact him, he says he has no money for me, and does not respond when I ask about his intention to repay his debt.

Am I able to take him to small claims court for the bills and rent that I paid, although it was a verbal agreement? What would I need to get in order to do so, i.e. documents, etc? What are the steps involved with taking someone to small claims court?

You can take him to court, but that is the issue proving it, any emails saying he can't pay or something to prove he was suppose to pay back ?

@Fr_Chuck I have no emails saying he cannot pay, but I have text messages.
