I want to go back to court to gain full custody of my 6 and 4 year olds. My ex and I went to court 2 years ago and he was given physical custody based on the fact that he had them for seven months and that I live 2 hours away. My ex has had multiple roommates the whole 2 years and has had his phone turned off six times, and has had his electricity turned off in the past and now has been given 30 days to vacate his home by his landlord. My ex has only been working for a week and his girlfriend is currently still unemployed so I fear that they are going to be homeless. My children always tell me that they want to live here with me and my husband and even my ex agrees that they want too he just will not let them. My ex is now telling me that he is thinking of moving, we are in Oregon, to Virginia. I am afraid I will never be able to see them as my ex has all ready canceled some of my previous visits due to him not having the gas money to pick them up from my house. What are my chances.

I would definitely talk to a lawyer and see what can be done. There might be enough information for a change in circumstances. If you can't get custody then you might be able to stop them from leaving if you can prove that it won't be beneficial to the kids.

Oregon also has service called Modest Means for those that might not be able to afford an atty. Here is the link for the PDF information on it.

Also let you the atty know that he has been interefering with your parenting time..
