My husband was violated by his p.o on a show cause and catching a charge while on probhation. He served the time for the charge which was at least four months but he goes to court and I am so scared that he will have 2 serve a lot of time! But this is his first violation what is going to happen anybody? I'm in va

I didn't quite understand that. So he was charged with a violation while on probation? He served 4 months in jail because of it but he goes into court today? So do you mean he was booked into county jail for probation violation and has been awaiting trial for it for for months am I correct? Well since it is his first violation, the judge may not be too harsh on him. However, this depends on your husbands particular case. Things will be taken into account such as: original charges, probation terms, probation status, length of probation, time served on probation, and time served in county for violation. If he is a stellar probationee and has some time under his belt, the judge may just restart his probation with the time served in county docked from his new term. It all depends of all these factors and it's up to the judge.

If I understand, he violated his probation, went to trial on the new charge, and served 4 months in jail on the new charge. During this time he never had a probation hearing to decide his probation ?

You did not tell us what the charges were or how long his probation was on first crime.

It is possible either way, very likey he will get tiimed served and be put back on probation. But if the crimes are related, he may get the full time.

His orignal charge was a felony possession and he was put on prob. He also served 6 months in jail For that and he caught a case a while on prob. Which was a misdeameanor running from the police. And in that time he served 4 months on that charge which then his p.o violated him for catching a violation while on prob. He was transferred from one jail to the next he has been locked up in the nextths waiting 2 go back in front of a judge today.
